1. Acceptance of the terms

By downloading, installing, registering for or using the Carrete application, the carrete.app website or any related service, you accept these Terms and Conditions of Use (the "Terms").

If you do not agree, do not use the service. The Privacy Policy, available at /privacidad, forms an integral part of these Terms and describes how we process your personal data.

2. Description of the service

Carrete lets users create carretes (shared photo albums for events), invite participants via link or QR code, take photos with analog film presets, configure shot caps and reveal strategies, and download images according to the event's rules.

The service is offered through mobile applications (iOS and Android) and, where applicable, a web version. We may modify, suspend or discontinue features with reasonable notice whenever possible.

3. Eligibility and account

You must be at least 13 years old to use the service. By registering you confirm that you meet this requirement.

To create an account you must provide a valid email address and a password of at least six characters. You are responsible for keeping your credentials confidential and for all activity on your account.

We may request email confirmation before allowing full access. We reserve the right to reject or cancel registrations that violate these Terms.

4. Roles: host and guest

Host: user who creates a carrete, configures its rules, can invite participants, manage the reveal, delete photos and acquire paid guest capacity.

Guest: user who joins a carrete via invitation and captures or views photos according to the event's configuration.

Anonymous session: if the host allows it, you can participate without an email account, providing a display name. In that mode you will not have the same account recovery guarantees as a registered user.

5. Carrete configuration

The host defines parameters such as: photo visibility between participants, whether signing in with email is required, guest capacity and shots per person, film preset, event dates and the reveal moment.

The host is responsible for inviting only authorized people and for complying with applicable law when processing data or images of third parties (including minors).

6. User content

You retain ownership of the photos and other content you upload. By uploading content, you grant us a non-exclusive, worldwide license limited to running the service: hosting, processing (including applying filters), showing to the authorized participants of the carrete and allowing downloads according to the event's configuration.

You warrant that you have the right to publish the content and that it does not infringe third-party rights or applicable laws.

It is prohibited to upload or share illegal content, defamation, content that violates the privacy of third parties without consent, sexual material involving minors, incitement to hatred, spam or malware. We may remove content and suspend accounts that violate these rules.

7. Carrete intellectual property

The Carrete trademark, the application design, the film presets, the software and the website materials are owned by Bitforge or its licensors. You do not acquire any rights over them other than the use permitted by these Terms.

Copying, modifying, decompiling or commercially exploiting the service without written authorization is not allowed.

8. In-app purchases

Some carretes require the purchase of an expanded guest capacity. Purchases are consumable per event (they are not recurring subscriptions). The free tier allows up to 5 guests; paid tiers range from USD $1.99 (10 guests) up to USD $99.99 (unlimited guests), per the current in-app catalog.

Payments are processed exclusively through the Apple App Store or Google Play Store. Their terms and refund policies apply. We do not store your card data.

Coupons or vouchers from authorized resellers may also be available as an alternative to in-store payment.

Purchases are not transferable between carretes unless the functionality explicitly allows it. Prices may change; the applicable price is the one shown at the time of purchase.

9. Availability and changes

The service is provided "as is" and "as available". We do not guarantee the absence of interruptions, data loss or compatibility with all devices.

We may perform maintenance, updates or changes to features. We will notify you of relevant changes when reasonable.

10. Limitation of liability

To the extent permitted by Chilean law, we will not be liable for indirect damages, lost profits or data loss arising from the use of the service.

We are not responsible for content published by users or for disputes between carrete participants. The host assumes the consequences of their configuration (for example, allowing anonymous sessions or live reveal).

Our total liability to you for any claim related to the service will be limited to the amount you have paid for in-app purchases in the twelve months preceding the event that gave rise to the claim, or to zero if you have made no purchases.

11. Suspension and termination

You can stop using the service and sign out at any time. To permanently delete your account, follow the process described in the Privacy Policy.

We may suspend or terminate your access if you breach these Terms, if required by law or for the safety of the service or other users.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Chile, without prejudice to the mandatory consumer protection rules that apply to you.

Any dispute will be submitted to the ordinary courts of justice of Santiago, Chile, unless legal provision dictates otherwise.

14. Modifications

We may modify these Terms. The current version will be published on this page with the last updated date.

Continued use of the service after the publication of changes constitutes acceptance of the updated Terms, unless the law requires additional express consent.
